33 year-old Replace Anres of Puna was arrested and charged for offenses related to habitually operating a vehicle under the influence of an intoxicant, driving with a suspended license, no insurance, and inattention to driving after a traffic collision at the intersection of Shower Drive and Kea‘au-Pahoa Road.
According to police, Anres, who was operating a Jeep Cherokee, rear-ended a Toyota 4-Runner that was at a complete stop. Anres later provided a breath sample indicating a 0.274 breath alcohol content.
On Monday, Anres made his initial Hilo District Court appearance where over Prosecutors’ objections, the District Court judge released Anres, who was previously in custody on $53,000.00 bail, on supervised release and ordered him to appear for a preliminary hearing on September 4.
As the Complaint alleges, Anres is charged with Habitually Operating a Vehicle Under the Influence of an Intoxicant (“OVUII”), Operating a Vehicle after License and Privilege have been Suspended or Revoked for OVUII, No No-Fault Insurance, and Inattention to Driving. Prosecutors also alleged that Anres was a highly intoxicated driver because his measurable amount of alcohol was 0.15 or more grams of alcohol per two-hundred ten liters of his breath. Habitually Operating a Vehicle Under the Influence of an Intoxicant is a class C felony offense and carries either a penalty of a five-year prison term or five years probation and up to twelve months in jail.
The case is being prosecuted by Deputy Prosecuting Attorney Brit Barker Pittullo.
