Court rules that mayor can discipline police chief

LIHUE, Hawaii (AP) — A judge has ruled that the Kauai County mayor has the power to suspend or discipline the police chief.
The Garden Island says that the chief judge of the 5th Circuit Court ruled Tuesday in a matter between the county Police Commission in its civil suit against Mayor Bernard P. Carvalho Jr.
Judge Randal Valenciano found that the mayor is the chief executive officer of the county, and has the authority over all departments unless the charter provides language in the alternative.
The issue stems from Feb. 2, when Carvalho suspended Kaua'i Chief of Police Darryl D. Perry from work for seven days.
The county's private counsel successfully argued that the charter gives the mayor legal authority to discipline and oversee the daily activities of commission-appointed department heads.
