HONOLULU (AP) — Prosecutors say they won't pursue drug possession charges against former University of Hawai`i star quarterback Colt Brennan following his July arrest.
Honolulu Prosecuting Attorney Keith Kaneshiro says in a statement that the decision was made based on a recent Hawai`i Supreme Court opinion and other similar court decisions on drug possession and the intent to possess.
A plastic packet containing cocaine residue was found in Brennan's rented car after a police officer pulled him over for speeding in Kailua. Brennan was arrested for driving under the influence, and a police report said he had a blood-alcohol level of 0.17 percent.
Kaneshiro says prosecutors couldn't have proven beyond a reasonable doubt that the plastic packet belonged to Brennan.
Brennan still faces charges of operating a vehicle under the influence of an intoxicant.
