PUC renewable energy order upheld
|

HONOLULU (AP) — The Hawaii Attorney General's Office is upholding a renewable energy order from the Public Utilities Commission even though only two of three commissioners cast a vote.
PUC member Leslie Kondo had claimed in a Jan. 4 filing that his exclusion violated commission rules and made its order invalid.
But the Attorney General's Office wrote in a recent opinion that only two commissioners are needed to make a decision as long as notice was provided to all commissioners.
The opinion was requested by PUC Chairman Carlito Caliboso.
The ruling dealt with a case that allows Hawaiian Electric to recoup millions of dollars in costs for investing in smart meters, storage batteries and transmission lines that connect its grid to outside renewable energy providers, such as wind farms.
