Court to decide whether Web site reporter is a journalist

HONOLULU (AP) _ A lawyer trying to get an Internet writer to testify and turn over notes for a court case says Web bloggers shouldn't have the same rights as mainstream reporters.

William McCorriston is an attorney representing landowner James Pflueger in a lawsuit over the failure of Kaloko Dam on Kauai.

He claims that Malia Zimmerman of Hawaiireporter-dot-com is a blogger who isn't entitled to withhold her sources of information.

He wants to compel her to share information about her reporting into the Kaloko Dam break.

A Hawaii Circuit Court judge will have to decide whether a reporter for a Web site publication is a journalist.

Judge Gary Chang will also have to decide whether journalists have a privilege to refuse to provide a court with confidential information to lawyers in a civil case.
